Expert Response

Hi Angela,

If you are planning to launch a small bakery business out of your home following the guidelines for cottage food exemption, you do not need to register with the Oregon Department of Agriculture. We have short guide to this legal exemption from licensing online: Oregon's Cottage Food Exemption.

Note that this law only allows for some types of baked goods to be produced in the home--baked goods that are not considered "potentially hazardous" and do not require refrigeration. Sales are capped at $51,200 annually. There are also specific requirements for labeling and record-keeping, as well as kitchen sanitation.

If your business plan does not meet each of the standards laid out in the law, you would need to obtain a domestic kitchen bakery license through the Oregon Department of Agriculture. You can read more about that on their website.

Thanks for using Ask Extension,

Jared
