Liability on Rented Land #916640

I have around 40 sheep that I keep on rented land. The land owners are asking me about liability and insurance for my animals. My understanding has been it is nearly impossible to get insured as a livestock producer at such a small scale, and furthermore that oregon law holds the livestock owner responsible for any issues as opposed to the landowner. Are you able to give me any confirmation or additional information on this subject?

  • Livestock Owner Liability: In Oregon, the livestock owner is generally held responsible for damages or injuries caused by their animals. This includes property damage, injuries to people, or harm to other animals. 
  • Landowner Liability: Landowners are typically not liable for incidents involving livestock they don’t own—unless they are actively involved in the care or management of the animals, or if there's negligence in maintaining safe conditions on the property. 

  • It is recommended that both the land owner and the leasing farmer hold farm insurance.  

     Insurance is available—even for operations with just a few dozen animals. This often falls under Farm Liability Insurance and can be an added line item.  For example, for my sheep and farm, my insurance covers liability if the sheep get out on the road and cause an accident.
