What are tiny black small bugs that fly attracted to water stay near light and house hold spraying don't kill them

We would need more information and photos (if possible), in order to identify what you are seeing. Are the insects found indoors near a water source or houseplants with damp soil? Are you finding them outdoors? All flies need water for part of their life cycle, so it is possible you might be seeing some type of flies, mosquitoes, or gnats. Insect activity outside, in general, will be greatly reduced now because of the cold temperatures.
