I have the santa Clara Creek in my back yard and I think it has a deadly night shade plant in it . It does have berries already , my question is what is the safest way to get rid of it . Thank you Steve Morse

Yes, it is in the Solanum nigrum group, generally referred to as Deadly Nightshade. It is an annual and can be pulled out. If you let the berries mature and drop it will return next year, but usually very easy to pull in garden soil. Not usually actually deadly, however, definitely not edible by man or beast.
