Next Door

Asked June 19, 2019, 9:24 PM EDT

The house next door to us in a residential subdivision was sold last January 2019 to a family that supposedly was going to rehab it and move in when it was done. Recently the owner mentioned that he was possibly making it into a senior home for aged folks that needed somewhere to live. Is this allowed in a single family neighborhood?

A good bit depends on your local zoning ordinance. The owner may be able to apply for a special use permit, which allows for a different use in the zoning district as long as they meet certain criteria. That criteria is typically set forth to avoid adverse impacts on neighbors.

Here is a MSUE article with a little more information: https://www.canr.msu.edu/news/difference_between_special_use_permits_and_variances

We recommend you review your local zoning ordinance, typically found on the local government website, and discuss with your Zoning Administrator.

Good luck!
