Berry classification

What type of plant is this? I originally thought it was a dogwood tree but doesn't seem to match description of one. Just curious as I have kids and want to know if these berries are toxic to humans. If you can help identify the plant I can take care of the rest

It is hard to make a positive identification of the plant from a photo, but I believe it is winterberry holly (Ilex verticillata). The fruit is often eaten by birds.
