Is this correct?

Twp has denied land division for property in class 401 their reason is it is located in the agricultural production zoning district and it does not meet the requirement minimum of 40 acres it is a 23 acre parcel now and need to split off 10 acres for hardship purpose

Without having all the necessary information to tell you if that is "correct" I can tell you that according to the Land Division Act (MCL 560.109) the township may adopt provisions related to lot size of divisions made within its jurisdiction. I recommend you obtain a copy of the township's land division ordinance and review the township's zoning ordinance for minimum lot size and other relevant provisions within the agricultural production district to see what options you have for dividing your property.
