Is this deadly nightshade?

This plant showed up in my front yard last year. I don't water it.
This year the plant has grown to 4' in diameter and has produced these purple flowers that only bloom at dusk. The little bit of research I did indicated that the plant is nightshade. I have not found any berries on the plant. If it is nightshade, do I need to take precautions to remove it?

This plant is not a nightshade. It is Colorado Four O'Clock (Mirabilis multiflora), a drought-tolerant perennial with a large taproot. Very attractive flowers that open late afternoon and remain open until the next morning. It may become aggressive, re-seeding itself readily
