Thanks for using our forum to get gardening information. Clearly the pine tree is alive. The thing about pines (not spruce or firs) they only have a bud at the terminal tip. As you mentioned something, most likely deer, ate the terminal bud so the recovery growth is from lower down. That tallest shoot on the right-hand side in the top photo will become your tree. I suggest you let both the old and the new grow for this summer. Then early next spring cut off the old just above the new shoot. Also, you will need to protect the terminal bud on the new shoot this winter. You could put fencing around the tree, or you can wrap the tip with a piece of light cardboard, which is called a bud cap. Here is more information on such a technique:

Bud caps are small squares of newspaper or cardstock stapled around the terminal buds of trees to protect them from deer browse. They are mostly used for conifers during winter and do not prevent the deer from browsing on the lateral or horizontal branches.

I see you have wood chip mulch around the tree - excellent! Water is very important when it is dry, right up until the ground freezes. Too much water can kill a tree so wait until the soil feels dry before watering and then give it a good slow soaking to get the soil wet 4-5 inches down. With TLC to this tree no need to replant!
