Is this a picture-wing fly? #872306

I believe this is a type of picture-wing fly, but I cannot find this particular fly after an internet search. Attached are three frames from a video I took. The video is interesting because it shows the fly waving its wings and then it appears to raise its head up and open (what looks to me like) its mouth. At first, I thought it was trying to attract prey using the "spider"-like images on its wings. But in looking at the video, I think it may have been trying to deter me as a perceived predator. I found it on an unknown plant that volunteers in my garden. I hope you can tell me what kind of fly this is and whether it is common in my area (suburban eastern Washington County). I had not come across it before.

Hi Elaine and thanks for your pictures of an insect I cannot identify either! It doesn't fit the classic picture-winged fly images and I can't match it with a Stiletto fly which was my first guess. Those wing spots are a real puzzle!

I would suggest you capture one and sent it in to Oregon State Insect ID lab. The following website will tell you how to package it and let's see if they can find it!
