any reason I could not remove dirt from area right of gutter, to where it levels out, if I need dirt?

It is certainly fine to move soil from one area of your yard to another place. The only thing you do not want to do is change the grade. You want the soil to slope away from your home to prevent water from coming inside. It would be okay to skim the top so it is even as long as you do not allow it to change the way it drains.
